Son, Daughter in Law Has No Legal Right to Live in Parents House verdict – Delhi high court

Judgement given by Delhi high court on 24 November 2016 has been surprising for all Indian families. Through this verdict Son’s legal right on parents house is not valid. A son has no legal right to take ownership of parents property or live there. Whether or not a son is married or unmarried he has no right to live with his parents. He can continue living with parents at their mercy or if relation between them is happy. This controversial verdict was given by Justice Pratibha Rani. We have to know more about situation in which such a verdict was passed by Judge before criticizing about it. Usually in most families parents and their sons, with their families lie together.

There are usually no problems between them. This court order is based on situations where family bonding between parents and their son’s go wrong. In many cases parents are not treated well by their son’s and their wives even though they are staying at parent’s property. When Delhi High court order regarding Son’s legal right on parents house it was criticized by lot of youngsters. They did it without knowing truth behind such a verdict. At the same time Court judgement on Son’s legal right on parents house was given positive feedback by most senior citizens. What is reason for that. It’s because youngsters have not gone through difficulties faced by senior citizens. Let’s go in detail about real verdict given by Justice Pratibha Rani of Delhi High Court. Judgement given by Justice Pratibha Rani was as follows,

“Merely because parents have allowed him to live in house so long, as his relations with the parents were cordial, does not mean that parents have to bear his burden throughout his life”. Old people are mostly not treated well by their sons. And they have spend their whole life building house and growing up their sons. So it is justifiable that parents are sole owners of the property r house they have built or bought. Son’s or daughters have no legal right on property or house owned by their parents. They can live there at mercy of their parents.

This verdict will create lot of chaos in India where there will be lot of supporters and opposer’s for this judgement. Through this verdict it has been made clear that Son or Daughter has no legal right on parent’s property, what ever be their marital status.

Children who have completed their legal age of 18 years can stay with parents at their mercy. If not they will have to work on their own or live alone and build up their life like their parents worked hard in building wealth, property.

A petition was filed by Sachin who is a Nangloi resident. It was against an order given by his parents for him to vacate house. Sachin said in Court that he is their son and has legal rights to live in that house with his wife and children.

Sachin also said that he had given money for construction of this house, but did not have any evidence to support his statement. Problems started when two sons of these parents occuppied two floors of the house. These sons and their families started doing things on their own and acted cruelly to their parents.

This made parents who are both senior citizens go o court demanding order against sons, daughter in laws to vacate from house. Parents said that son’s and their family was not giving any mney for house hold expenses and was not helping in household jobs too.

Electricity bills and other expenses were also not paid by sons and all this became burden on parents. This made them go to Court to get their house back from custody of these two sons who made their life very difficult.

Delhi High court ruled out petition given by one son Sachin, who demanded legal protection to stay in parent’s house. Other son did not go to court. So as per Delhi High Court order on 24 November 2016 (24-11-16) by Justice Pratibha Rani, sons have to vacate from this house.

In foreign countries like America all youngsters work on their own by doing part time jobs while studying itself. They earn money used for their own college expenses and all. This way of living makes them stand on their legs and build up their living on own.

In a country like India where situations are different it will be difficult for youngsters to find their living on own or staying alone away from parents without their support.

If situations in India are changed life of everyone will be changed. There will be no one without a job or place to live if such a method of living is followed in India.
